Umpire Assistant SMS Terms and Conditions

Company: Umpire Assistant Company, Conifer, Colorado, USA (“Company,” “we,” “us,” or “our”).

These SMS Terms and Conditions (“SMS Terms”) govern SMS and MMS communications sent by or on behalf of Umpire Assistant Company. They supplement our End User License Agreement and Privacy Policy.

1. Types of Messages

We use SMS and MMS primarily for manual, one-to-one conversational business communications.

Messages may include:

• Responses to inquiries.
• Scheduling and appointment coordination.
• Requested follow-ups.
• Project or property-claim communications.
• Account or service-related information.
• Documents, links, or information requested by the recipient.
• Other communications related to an existing or prospective business relationship.

We do not use purchased contact lists or send unsolicited bulk text-message campaigns.

2. Consent

We may obtain consent to communicate by text when a recipient:

• Requests or agrees to receive text messages during a telephone call, meeting, email exchange, or other direct interaction.
• Initiates a text-message conversation with us.
• Provides a mobile number and requests that we respond or communicate by text.
• Uses another consent method that clearly indicates agreement to receive text messages from us.

Consent to receive text messages is not a condition of purchasing any product or service.

3. Message Frequency

Message frequency varies based on the recipient’s communications and interactions with us. Because our messages are primarily conversational, the number and timing of messages will depend on the nature of the inquiry, appointment, project, claim, or business relationship.

4. Message and Data Rates

Message and data rates may apply depending on the recipient’s wireless carrier and service plan.

5. Opt-Out

Recipients may opt out of receiving text messages from a particular Company telephone number at any time by replying STOP.

After an opt-out request, the recipient may receive one final message confirming that the request has been processed. We will then stop sending text messages from that number unless the recipient later provides consent to resume messaging.

7. Mobile Information and Privacy

We do not sell, rent, or share mobile telephone numbers, SMS opt-in information, or text-message consent with third parties or affiliates for their marketing or promotional purposes.

No mobile opt-in information or text-message consent will be shared with third parties or affiliates for marketing purposes.

We may provide mobile messaging information to telecommunications carriers and communications-platform service providers solely as necessary to transmit, manage, secure, and support our messages.

8. Delivery and Availability

Message delivery is subject to effective transmission by wireless carriers and communications providers. Delivery may be delayed or unsuccessful because of circumstances outside our control.

Wireless carriers are not responsible for delayed or undelivered messages.

SMS and MMS availability may vary by carrier, device, service plan, telephone number, and location.

9. Recipient Responsibilities

Recipients are responsible for:

• Providing a mobile number they own or are authorized to use.
• Notifying us if a mobile number changes or is reassigned.
• Maintaining a device and wireless service capable of receiving SMS or MMS messages.
• Avoiding the transmission of highly sensitive or confidential information through SMS or MMS.

10. Changes to These SMS Terms

We may update these SMS Terms from time to time. Material changes will be indicated by updating the Effective Date above. Continued participation in SMS or MMS communications after the Effective Date signifies acceptance of the updated SMS Terms.

11. Relationship to Other Terms

These SMS Terms supplement our End User License Agreement at /eula/ and Privacy Policy at /privacy/.

If there is a conflict specifically concerning SMS or MMS communications, these SMS Terms control that issue.
